Finding Family Stories will follow the Code of Ethics and Code of Conduct established by AAGRA.
It is the responsibility of the client to clearly outline the research required in the client agreement. It is the responsibility of the researcher to be clear about the client’s requirements.
It is the responsibility of the client to ensure details of previous research have been provided to the researcher to avoid a duplication of research and/or costs.
Finding Family Stories will not exceed the time stipulated by the client. If determined that extra time is required, the researcher must discuss this with the client before proceeding. Paid research time includes research, analysis, sourcing of records, report writing and time spent liaising with the client.
Positive research results cannot be guaranteed and time spent on negative findings and unsuccessful searches will still be charged.
A list of sources checked, and the results of the search, will be provided.
Additional expenses, such as travel, must be discussed with the client before proceeding.
Costs of documents are charged separately, at cost. Further, Finding Family Stories will not exceed the maximum cost agreed for documents.
If the commissioned work requires less hours than agreed, then Finding Family Stories will only charge for time taken.
If it is necessary to subcontract part of the work, the researcher will discuss with the client.
Some larger projects may require a fee to prepare a proposal and quotation. This will be discussed after receiving instructions and before commencement.
Any changes to the client agreement must be discussed and agreed to by both parties.
Payment Terms
Finding Family Stories will send an invoice/tax invoice that conforms with Australian standards when requesting payment for research.
The client will pay a deposit of fifty per cent (50%) up front, which may be used to purchase documents, including transcripts or certificates.
The remainder is to be paid upon completion of the commissioned work and prior to it being sent to the client. Research will commence on receipt of a signed client agreement, any previous research, and the deposit amount.
Payment is required within 14 days of the date of the invoice being issued.
All prices are quoted and need to be paid in Australian Dollars (AUD). The method of payment is by direct bank transfer. Bank account details will be provided on the invoice.
Refunds and Cancellations
Completed research is non-refundable.
Cancellation made before research commences is refundable.
Cancellations cannot be accepted once work has commenced.
Confidentiality
Client details such as name, personal details, information not already in the public domain or a matter of public record or public knowledge, will remain confidential in accordance with statutory privacy principles. These will not be shared with third parties, unless the permission is given by the client. If information is required by a third party, the researcher will discuss this with the client. Examples when permission may be sought are when accessing documents under Freedom of Information, details may be needed by the relevant repository for assessment of the application.
The client reserves the right to request alternative confidentiality clauses prior to the research commencing if they feel it necessary.
Finding Family Stories may be required, in certain circumstances, to disclose information and will do so only if it is required by law, by a court ruling or to protect the rights and safety of our clients. The client will be informed if this occurs.
Copyright
Finding Family Stories retains copyright over research work, including reports, and retains the right to make further use of the results of this work. The client is granted non-exclusive license to use the research for personal purposes but cannot publish without prior permission of Finding Family Stories. If shared with others for personal use, Finding Family Stories must be credited as the source.
Documents provided in a research report may require copyright permissions if they are to be published. It is the responsibility of the client to obtain relevant permission to publish these documents with or without the research report.
Limitation of Liability
While every effort is made to provide accurate and thorough research, the client understands that historical records may be incomplete or inaccurate. Finding Family Stories is not liable for any errors or omissions in the information provided.
